Terms and Conditions
The terms that apply when you engage Creative Quest Ltd for creative, marketing or technology work, and when you use this website.
1. About these terms
These terms apply to services provided by Creative Quest Ltd, registered in Tanzania and operating from Moshi, Kilimanjaro. They also cover your use of this website.
Where a signed proposal, quotation or contract exists for a specific engagement, that document takes precedence over anything written here.
2. Quotations and acceptance
Quotations set out scope, deliverables, timing and cost. A quotation remains valid for thirty days from issue unless stated otherwise.
Work begins once you accept the quotation in writing and any agreed deposit has been received.
3. Fees and payment
Unless agreed otherwise, engagements are invoiced with a deposit before work starts and the balance on delivery. Retained arrangements are invoiced monthly in advance.
Travel, accommodation, permits, licensed music, stock assets, hosting and third-party subscriptions are quoted separately and recharged at cost unless included in your quotation.
4. Your responsibilities
You agree to provide accurate information, timely feedback, access to locations and people, and any brand assets required for the work.
Delays in approvals or access may move agreed delivery dates. We will tell you in writing when that happens.
5. Revisions and approval
Each deliverable includes the number of revision rounds stated in the quotation. Additional rounds, or changes that alter agreed scope, are quoted before they are carried out.
A deliverable is treated as approved once you confirm in writing, or after fourteen days without comment following delivery.
6. Intellectual property and usage
On full payment, you receive the rights to use the agreed final deliverables for the purposes described in the quotation.
Unless expressly assigned in writing, Creative Quest retains ownership of raw footage, working files, source code libraries and internal tooling. Third-party assets remain subject to their own licences.
7. Portfolio and credit
We may show completed work in our portfolio, on this website and on our social channels, unless you ask us in writing not to.
Confidential material, unreleased products and anything covered by a non-disclosure agreement are excluded from this.
8. Cancellation and postponement
If you cancel after acceptance, deposits cover work already carried out and commitments already made on your behalf.
Production days cancelled or postponed with less than seventy-two hours' notice may be charged in full where crew and equipment have been reserved.
9. Liability
We carry out work with reasonable skill and care. Our total liability in connection with an engagement is limited to the fees paid for that engagement.
We are not liable for indirect or consequential loss, including loss of profit, revenue or anticipated savings.
10. Governing law
These terms are governed by the laws of the United Republic of Tanzania, and disputes fall under the jurisdiction of its courts.
We will always try to resolve a disagreement by discussion first.
